We only ever act for landowners, so our clients can maximise their land’s value.  We negotiate Development Options, Promotional Agreements and Conditional Contract Sales on behalf of  our landowners to find funding from  Promoters and Developers.

Not only do we put your site forward through the Strategic Housing Land Availability Assessment (SHELAA), we will speak with local planning officers and where necessary produce vision documents to paint the vision of the development.

We negotiate on your behalf

Obtaining planning permission for residential development is not a cheap hobby.  Many landowners and farmers do not want to take the financial risk and look to find Strategic Land Promoters or Developers to fund the planning process.  Farmers have the decision to make as to whether they:

  • pay for applying for planning permission themselves; or 
  • entering into a conditional contract ; or
  • enter into a  Promotional Agreements with Promoters who funds the  planning application and then the landowner sell the land to everyone to raise the highest possible price; or 
  • enter into an Option Agreement with either a builder; or 
  • sell prior to planning subject to an overage on obtaining planning

WebbPaton act for Landowners only, we do the early stages of planning process in order that your land is identified to planning officers.  We then find the money and negotiate the Heads of Terms for Promotional Agreement and Development Land Options, with a view of obtaining the best commercial deal for our farming client.  

But before we do this we need to persuade those with money that your land is highly suited for development.

We attend meetings on your behalf

We attend meetings acting for the Landowner whilst the planning application is going though planning with an eye of making sure the Promoter or Option Holder maximises your land’s value.  

The important part of this is the Section 106 negotiations where we can save substantial sums of money adding value to your land when it is sold.  

We also observe the infrastructure costs and whether the planners are pushing for things which are uncommercial.

Farm buildings planning permission

Farmyards, farm buildings (even portal frames) and traditional barns can obtain planning permission for a residential use through the Permitted Development Rights under Class Q, or via a full or outline planning application or more cheaper Permission in Principle (PiP) application.  Becky Farthing, Libby Barron and Helen Wiltshire are happy to discuss how to obtain planning in your farmyard under both Class Q and Class R.
